It\u2019s a personally difficult situation, where our personal lives should take precedence over our commitments at work. It often comes with a number of time commitments, from being with family to arranging a suitable memorial and processing your grief, which can take time. That\u2019s where bereavement leave comes in, giving you the time you need to focus on what matters.\n<h2 id=\"what-is-bereavement-leave\">What is bereavement leave?<\/h2>\nBereavement leave in New Zealand is a specified leave which eligible employees can choose to take to take care of matters related to a death of someone they know. Employers must continue to pay employees throughout this time. Currently under the Holidays Act, employees are only allowed to take bereavement leave if they&#8217;ve worked for their employer for a minimum of six months, for an average of 10 hours per week and at least one hour in every week or 40 hours in every month.<\/span>\n\nIf an employee isn\u2019t eligible for bereavement leave, employers can give them the option to <a href=\"https:\/\/www.employment.govt.nz\/leave-and-holidays\/bereavement-leave\/#scrollto-if-an-employee-doesn_0027t-qualify-for_002c-or-wants-extra_002c-bereavement-leave\" rel=\"noopener\" target=\"_blank\">take the leave in advance<\/a>, or to use their annual leave to take the time off. Employers cannot make employees use their annual leave for this purpose unless the employee requests it.\n<h2 id=\"can-an-employer-refuse-bereavement-leave\">Can an employer refuse bereavement leave?<\/h2>\nEmployers cannot refuse bereavement leave if the employee is entitled to it. They also cannot require proof of a bereavement as a condition of taking the leave. Instead, the interaction between both the employer and employee should be done honestly and in good faith.\n<h2 id=\"how-long-is-bereavement-leave-in-new-zealand\">How long is bereavement leave in New Zealand?<\/h2>\nAn eligible employee is entitled to a <strong>minimum of three days bereavement leave, per bereavement<\/strong>. This is dependant on whether they meet any of the following circumstances :\n<ul>\n<li aria-level=\"1\">The employee\u2019s immediate family member dies eg. <span style=\"font-weight: 400;\">partner, spouse, sibling, parent, child, grandparent, grandchild, parent-in-law<\/span><\/li>\n<li aria-level=\"1\">The employee experiences a miscarriage or stillbirth<\/li>\n<li aria-level=\"1\">Another person has had a miscarriage or stillbirth and the employee:\n<ul>\n<li aria-level=\"2\">Is the person\u2019s partner<\/li>\n<li aria-level=\"2\">Would have been the biological parents of the child who passed away<\/li>\n<li aria-level=\"2\">Was due to be the primary carer of the child who passed away<\/li>\n<li aria-level=\"2\">Is the partner of a person who was due to be the primary carer of the child<\/li>\n<\/ul>\n<\/li>\n<\/ul>\nFor all other bereavements, an eligible employee is entitled to a<strong> minimum of one day of bereavement leave, per bereavement, <span style=\"font-weight: 400;\">and their employer accepts they\u2019ve had a bereavement. <\/span><\/strong>\n\nWhether the employer accepts they\u2019ve had a bereavement tends to depend on how close the employee was to the person who has passed away, if they have obligations in relation to the death, or any cultural responsibilities. Again, good faith applies here and employers are expected to be fair.\n\nEmployers can choose to grant extra bereavement leave on top of the legal allocation at their discretion.\n\n<img loading=\"lazy\" decoding=\"async\" alt=\"Two people sit at a table, only their hands visible. Employers can support their team members primarily in ensuring they have the time they need, and by being compassionate to their needs.\n\nThis starts with <a href=\"https:\/\/www.business.govt.nz\/hiring-and-managing\/handling-holidays-and-leave\/helping-staff-with-bereavement-leave\/\" rel=\"noopener\" target=\"_blank\">being clear about the leave they\u2019re entitled to<\/a>, and if they\u2019re not yet entitled, looking at ways to ensure they can take care of their personal life away from work. This could be bereavement leave in advance, or giving them the option to take paid special leave or annual leave. It&#8217;s really important to note that the employer <strong>cannot<\/strong> force the employee to use any other leave in the event of a bereavement, and the decision must be employee-led.\n\nBeyond that, it\u2019s all about being <a href=\"https:\/\/employmenthero.com\/nz\/resources\/wellness-at-work\/\" rel=\"noopener\" target=\"_blank\">kind and respectful<\/a>. If you\u2019re managing an employee who is grieving the death of someone close to them, it\u2019s a <a href=\"https:\/\/employmenthero.com\/nz\/resources\/leaders-guide-to-grief\/\" rel=\"noopener\" target=\"_blank\">case of using your people skills<\/a> to understand what will be supportive in each scenario.\n\nThis could be sending sympathy flowers to their home from the business, or just giving them the flexibility they need as they return to work. You may also want to make them aware of an Employee Assistance Program (EAP) if you have one, so they can get access to professional support.\n\nCrucially, it\u2019s a time where <a href=\"https:\/\/employmenthero.com\/nz\/blog\/boundaries-at-work\/\" rel=\"noopener\" target=\"_blank\">privacy is really important<\/a>. Let the employee decide how much is shared about their situation \u2013 some people will want their team at work to know what\u2019s happened, and some will want to keep it entirely confidential. It\u2019s up to you as a manager to check with them first, and to do so with a light touch.\n<h2 id=\"creating-a-bereavement-leave-policy\">Creating a bereavement leave policy<\/h2>\nAll employees in a business should be aware of their entitlements in the event of a bereavement. That\u2019s why it\u2019s key to have a policy on bereavement leave that everyone can be aware of and acknowledge.\n\nThe policy should include:\n<ul>\n<li aria-level=\"1\">Number of working days provided as bereavement leave<\/li>\n<li aria-level=\"1\">The eligibility period of when the leave can be taken<\/li>\n<li aria-level=\"1\"><span style=\"font-weight: 400;\">Whether an extension to bereavement leave is paid or unpaid<\/span><\/li>\n<li aria-level=\"1\">How an \u2018immediate family member\u2019 is defined (spouse, parents, siblings, etc)<\/li>\n<\/ul>\n<h2 id=\"the-wrap-up\">The wrap up<\/h2>\nGrieving and loss are sadly an inevitable part of life.
