The Accredited Employer Work Visa (AEWV) was introduced to replace six previous visas, endeavouring to simplify the overall process for both migrants and their employers.\n\nIt was a two-part system \u2013\u00a0New Zealand employers had to apply for accredited status, and migrant workers had to apply for the AEWV once they\u2019d received a job offer from an accredited company. Now, as of 28 March 2024, there are <a href=\"https:\/\/www.immigration.govt.nz\/about-us\/media-centre\/common-topics\/accredited-employer-work-visa-aewv\" rel=\"noopener\" target=\"_blank\">33,977 accredited employers<\/a> in the country. A whopping 115,483 AEWV applications have been processed since the scheme\u2019s introduction in 2022.\n\nEffective as of <a href=\"https:\/\/www.beehive.govt.nz\/release\/government-responds-unsustainable-net-migration\" rel=\"noopener\" target=\"_blank\">7 April 2024<\/a>, the New Zealand Government has introduced a number of changes to the AEWV which will affect both employers and employees. We\u2019re here to break down exactly what they mean for you and your business.\n<h2 id=\"baseline-rights-and-responsibilities-for-aewv-holders-and-their-employers\">Baseline rights and responsibilities for AEWV holders and their employers<\/h2>\nIt\u2019s important that everyone who is a part of the Accredited Employer scheme is aware of the rights they hold \u2013\u00a0and the limits of the conditions they operate under.\n<h3 id=\"rights-for-aewv-holders\">Rights for AEWV holders<\/h3>\nThose who are hold an <a href=\"https:\/\/www.immigration.govt.nz\/new-zealand-visas\/visas\/visa\/accredited-employer-work-visa\" rel=\"noopener\" target=\"_blank\">Accredited Employer Work Visa<\/a> have the right to:\n<ul>\n<li aria-level=\"1\">Work in New Zealand for the same accredited employer.<\/li>\n<li aria-level=\"1\">Study for up to three months in any 12 month period, or complete study required as part of their employment.<\/li>\n<li aria-level=\"1\">Stay in New Zealand for up to <a href=\"https:\/\/www.immigration.govt.nz\/new-zealand-visas\/preparing-a-visa-application\/working-in-nz\/accredited-employer-work-visa\" rel=\"noopener\" target=\"_blank\">5 years<\/a> \u2013\u00a0although the exact length depends on conditions.<\/li>\n<li aria-level=\"1\">Apply for certain residency visas once they reach the correct criteria (Straight to Residence Visa, Work to Residence Visa, Care Workforce Work to Residence Visa or Transport Work to Residence Visa).<\/li>\n<li aria-level=\"1\">Use skilled work experience to claim points towards the Skilled Migrant Category Resident Visa (if eligible).<\/li>\n<\/ul>\n<h3 id=\"responsibilities-for-accredited-employers\">Responsibilities for Accredited Employers<\/h3>\nEmployers can get accredited to hire migrant employees for up to 5 years, and can apply for 1 of 4 different levels of accreditation through Immigration New Zealand. Accredited employers have to meet the following <a href=\"https:\/\/www.immigration.govt.nz\/new-zealand-visas\/preparing-a-visa-application\/working-in-nz\/work-rights\/your-employers-commitments-to-hire-you-on-an-aewv\" rel=\"noopener\" target=\"_blank\">basic requirements<\/a> in order to maintain their accredited status:\n<ul>\n<li aria-level=\"1\">Comply with New Zealand employment laws and standards.<\/li>\n<li aria-level=\"1\">Provide <a href=\"https:\/\/www.immigration.govt.nz\/new-zealand-visas\/preparing-a-visa-application\/working-in-nz\/work-rights\/your-employers-commitments-to-hire-you-on-an-aewv\" rel=\"noopener\" target=\"_blank\">important information<\/a> related to their migrant employee\u2019s re-settlement in New Zealand, such as how to get an IRD number, specific job hazards, transport and accommodation options and Citizens Advice Bureau services.<\/li>\n<li aria-level=\"1\">Give sufficient time to complete Employment New Zealand\u2019s <a href=\"https:\/\/employment.elearning.ac.nz\/\" rel=\"noopener\" target=\"_blank\">learning modules<\/a> on employment rights during work hours.<\/li>\n<\/ul>\n<h2 id=\"the-latest-changes-to-the-aewv\">The latest changes to the AEWV<\/h2>\nImmigration Minister, Hon Erica Stanford, announced <a href=\"https:\/\/www.beehive.govt.nz\/release\/government-responds-unsustainable-net-migration\" rel=\"noopener\" target=\"_blank\">a raft of changes to the scheme<\/a> on 7 April 2024, effective immediately. The changes were cited as being to \u2018ensure New Zealand is attracting the skills it needs, and reducing the vulnerability of migrants to exploitation.\u2019\n\nThe changes are as follows\u2026\n<h3 id=\"changes-for-accredited-employers\">Changes for accredited employers<\/h3>\nEmployers now have to go through a number of increased checks, and have to meet a number of new requirements to hire an AEWV holder.\n<h4 id=\"minimum-hours\">Minimum hours<\/h4>\nAll AEWVs will now come with the condition that migrants are employed for at least 30 hours a week. Employers may not employ visa holders on agreements with hours less than that.\n<h4 id=\"skill-checks\">Skill checks<\/h4>\nEmployers must now take \u2018reasonable steps\u2019 to ensure that a migrant is suitably skilled before formally offering the role (g. A practical test or documents that support their CV).\n\nThey must also ensure that a migrant meets one of the newly introduced criteria for their work visa, before asking them to apply for an AEWV. They must meet one of the following:\n<ul>\n<li aria-level=\"1\">The job they will be taking is on the <a href=\"https:\/\/www.immigration.govt.nz\/new-zealand-visas\/preparing-a-visa-application\/working-in-nz\/qualifications-for-work\/green-list-occupations\" rel=\"noopener\" target=\"_blank\">Green List<\/a> and they meet the designated role\u2019s job requirements.<\/li>\n<li aria-level=\"1\">The job they will take pays at least $59.32 an hour (twice the February 2023 median wage).<\/li>\n<li aria-level=\"1\">They have 3 years or more of relevant work experience.<\/li>\n<li aria-level=\"1\">They have a qualification of <a href=\"https:\/\/www2.nzqa.govt.nz\/qualifications-and-standards\/about-new-zealand-qualifications-credentials-framework\/\">Level 4 or higher<\/a> on the New Zealand Qualifications and Credentials Framework (NZQCF).<\/li>\n<\/ul>\n<h4 id=\"breaches-of-compliance\">Breaches of compliance<\/h4>\nRules have been tightened for employers found in breach of accreditation. They may have their accreditation suspended while being actively investigated for any type of breach. Prior to these changes, suspensions had only been for certain breaches.\n<h4 id=\"hire-according-to-anzsco-skill-levels\">Hire according to ANZSCO skill levels<\/h4>\nANZSCO skill levels will now factor into the assessment of AEWV applications \u2013\u00a0we\u2019ll go into this further down in the AEWV applicants\u2019 changes.\n\nThis will be a challenging one for some employers. The <a href=\"https:\/\/www.immigration.govt.nz\/new-zealand-visas\/preparing-a-visa-application\/working-in-nz\/qualifications-for-work\/check-anzsco-list\" rel=\"noopener\" target=\"_blank\">ANZSCO level classification<\/a> can be complex, as it often considers an employee\u2019s level of education and training in their individual role. We\u2019d highly recommend carefully <a href=\"https:\/\/aria.stats.govt.nz\/aria\/#ClassificationView:uri=http:\/\/stats.govt.nz\/cms\/ClassificationVersion\/hgbQw1g89dLcxOHS\" rel=\"noopener\" target=\"_blank\">referring to the classification<\/a> and checking it against your current AEWV job role, so you know any potential challenges that could arise.\n<h4 id=\"proof-of-talent-shortage\">Proof of talent shortage<\/h4>\nIf your vacant role is not on the Green List and pays less than twice the February 2023 median wage, you already need to advertise the role locally in New Zealand first. However, there is a <a href=\"https:\/\/www.immigration.govt.nz\/employ-migrants\/new-employer-accreditation-and-work-visa\/passing-the-job-check\/advertise-a-job-and-engage-with-work-and-income\" rel=\"noopener\" target=\"_blank\">new and specific definition<\/a> of \u2018suitable and available New Zealanders\u2019, and you will need to adhere to that definition when declaring that no applicants met it.\n<h4 id=\"inform-immigration-nz-of-employee-exits\">Inform Immigration NZ of employee exits<\/h4>\nA brand new change is that accredited employers will have to let Immigration New Zealand know if an AEWV holder leaves their employment a month or more before their visa expires. They must let Immigration New Zealand know within ten days, or risk a <a href=\"https:\/\/www.immigration.govt.nz\/employ-migrants\/new-employer-accreditation-and-work-visa\/non-compliance-stand-down-bans\/meeting-your-aewv-accredited-employer-obligations\" rel=\"noopener\" target=\"_blank\">breach of their conditions<\/a>.\n\nPlease note that this will not apply to existing accredited employers until they renew or upgrade their accreditation status.\n<h4 id=\"the-end-of-franchisee-accreditation\">The end of franchisee accreditation<\/h4>\nThe franchisee accreditation category for the AEW was disestablished on 16 June 2024, meaning that franchisee employers will have to switch to one of the other employment accreditation types.\n<h3 id=\"changes-for-new-aewv-applicants\">Changes for new AEWV applicants<\/h3>\nObtaining an AEWV will become more challenging to certain applicants, with a few specific rule changes.\n<h4 id=\"new-minimum-skills\">New minimum skills<\/h4>\nAs already mentioned in the accredited employer section, AEWV applicants will need to show evidence of their work experience and skills relating to the role they have secured.\n\nAdditionally, unless their role is on the Green List or paid twice the median wage, they must now have one of the following:\n<ul>\n<li aria-level=\"1\">At least three years relevant work experience, or<\/li>\n<li aria-level=\"1\">A relevant qualification at level 4 or above of the <a href=\"https:\/\/www2.nzqa.govt.nz\/qualifications-and-standards\/about-new-zealand-qualifications-credentials-framework\/level-descriptors-nzqcf\/\" rel=\"noopener\" target=\"_blank\">New Zealand Qualifications and Credentials Framework<\/a> (NZQCF).<\/li>\n<\/ul>\n<h4 id=\"a-minimum-standard-of-english-for-some-roles\">A minimum standard of English for some roles<\/h4>\nIf the role is ANZSCO level 4 or 5, AEWV applicants must show that they can <a href=\"https:\/\/www.immigration.govt.nz\/new-zealand-visas\/preparing-a-visa-application\/english-language\/english-language-test-results-for-the-accredited-employer-work-visa\" rel=\"noopener\" target=\"_blank\">speak and understand English<\/a>. This will not apply to those who have already applied for the visa prior to 7 April 2024 or to partners or children of an AEWV applicant.\n<h4 id=\"shorter-visa-lengths-for-certain-jobs\">Shorter visa lengths for certain jobs<\/h4>\nFor ANZSCO level 4 and 5 jobs that are not on the Green List, not in transport and care sector agreements, or not earning 1.5 times the median wage, there is a new shorter visa length. The maximum visa length has been <a href=\"https:\/\/www.immigration.govt.nz\/about-us\/media-centre\/news-notifications\/changes-to-the-accredited-employer-work-visa-aewv\" rel=\"noopener\" target=\"_blank\">reduced to two years<\/a>, and the maximum continuous stay in New Zealand on AEWVs is now three years.\n\nThis applies to those who applied for their first AEWV on or after 7 April 2024 or before 21 June 2023.\n<h3 id=\"changes-for-existing-aewv-holders\">Changes for existing AEWV holders<\/h3>\nFor those who applied for their first AEWV before 21 June 2023 and are working in an ANZSCO level 4 and 5 job, paying at or above the required AEWV, and hold a three year visa, they won\u2019t be able to access the <a href=\"https:\/\/www.immigration.govt.nz\/about-us\/media-centre\/news-notifications\/changes-to-the-accredited-employer-work-visa-aewv\" rel=\"noopener\" target=\"_blank\">maximum time of three years<\/a> should they reapply for the visa.\n\nAn exception applies for those in an ANZSCO level 4 and 5 job who are already on a <a href=\"https:\/\/www.immigration.govt.nz\/new-zealand-visas\/preparing-a-visa-application\/living-in-new-zealand-permanently\/new-zealand-skilled-residence-pathways\" rel=\"noopener\" target=\"_blank\">pathway to residence<\/a>.\n\nAdditionally, from 26 June 2024, people holding an AEWV at ANSO levels 4 and 5 without a pathway to residency will no longer be able to support work, visitor or student visa applications for their partners and dependent children.\n<h2 id=\"additional-changes-to-the-green-list\">Additional changes to the Green List<\/h2>\nAt the same time as the AEWV announcements, there were some changes to roles on the <a href=\"https:\/\/www.immigration.govt.nz\/new-zealand-visas\/preparing-a-visa-application\/working-in-nz\/qualifications-for-work\/green-list-occupations\" rel=\"noopener\" target=\"_blank\">Green List<\/a>. This may be relevant if you\u2019re checking whether any of your employees may be exempt to some of the rules named above.\n\nSix roles have <a href=\"https:\/\/www.immigration.govt.nz\/about-us\/media-centre\/news-notifications\/changes-to-work-to-residence-and-occupations-on-the-green-list\" rel=\"noopener\" target=\"_blank\">now been added<\/a> to the Green List:\n<ul>\n<li aria-level=\"1\">Straight to Residence Category\n<ul>\n<li aria-level=\"2\">Aviation Engineer<\/li>\n<li aria-level=\"2\">Naval Architect<\/li>\n<li aria-level=\"2\">ICT Database and Systems Administrator<\/li>\n<li aria-level=\"2\">Mechanical Engineering Technician<\/li>\n<li aria-level=\"2\">Aircraft Maintenance Engineer<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li aria-level=\"1\">Work to Residence Category\n<ul>\n<li aria-level=\"2\">Corrections Officer<\/li>\n<\/ul>\n<\/li>\n<\/ul>\nThe previous Government had also announced the following roles to be later added to the Green List.
