For those taking parental leave, having that time away from work will give them the opportunity to spend time with their new arrival and find a \u2018new normal\u2019 in their day to day life. <\/p>\n\n\n\n<p>Of course, while parental leave is a critical benefit for new parents, it can arrive with some mixed feelings. Employees may feel a little torn about leaving their workplace and their responsibilities in another person\u2019s hands. They may worry that they\u2019ll be out of the loop on their return, and that when that happens, it\u2019ll be a steep learning curve. <\/p>\n\n\n\n<p>That\u2019s where the concept of \u201ckeeping in touch\u201d (KIT) days can help, both for the employee and the employer. We\u2019re here to take you through how they work, whether they&#8217;re a legal requirement and how to use them while remaining compliant.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"first-up-a-parental-leave-overview\">First up \u2013 a parental leave overview<\/h2>\n\n\n\n<p>Whether an employee is legally entitled to parental leave and the length of time they\u2019re entitled to can be complicated, and depends on a number of factors. It\u2019s important that employers are aware of eligibility requirements and what is required of them to ensure an easy and fair process. <\/p>\n\n\n\n<p>In order to be eligible for parental leave in New Zealand, you need to meet the following criteria: <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>You work for a NZ employer,<\/li>\n\n\n\n<li>You will have worked as an employee for an average of 10 hours a week for any 26 weeks of the 52 weeks before the child arrives (not necessarily for the same employer throughout),<\/li>\n\n\n\n<li>You pay income tax to Inland Revenue, and<\/li>\n\n\n\n<li>You\u2019re in an employment relationship which is subject to employment law.<\/li>\n<\/ul>\n\n\n\n<p>Eligible employees must give their employers at least <a href=\"https:\/\/www.employment.govt.nz\/leave-and-holidays\/parental-leave\/how-to-apply-for-parental-leave\/\" target=\"_blank\" rel=\"noopener\">14 days written notice<\/a> if they want to take parental leave. <\/p>\n\n\n\n<p>Government parental leave payments are available for eligible employees on parental leave and can be applied to through Inland Revenue. Otherwise, an employee could be considered as being back at work, and lose access to their government parental leave payments. The rules are:\n<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>That the employee only does a maximum total of 64 hours of paid work for their employer during their parental leave payment period, and<\/li>\n\n\n\n<li>That the work is not done within the first 28 days after the birth of the child.<\/li>\n<\/ul>\n\n\n\n<p>The employee could work full days, part days, a few hours at a time or 64 hours in a consecutive period. <\/p>\n\n\n\n<p>An exception applies to primary carers of preterm babies who are receiving a preterm baby payment. They are eligible for additional \u201ckeeping in touch\u201d days and may work on KIT days during the preterm baby payment period for up to a total of 3 hours, multiplied by the number of weeks that they receive the payment. These additional work hours do not affect the ability of these parents to get parental leave payments or take regular KIT days. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"what-employees-can-do-on-these-days\">What employees can do on these days<\/h3>\n\n\n\n<p>\nEmployees may choose to complete a number of <a href=\"https:\/\/employsure.co.nz\/guides\/maternity-and-parental-leave\/keeping-in-touch-days\" rel=\"noopener\" target=\"_blank\">work-related activities<\/a> during \u201ckeeping in touch\u201d days, but they must contribute to the employee\u2019s transition back to work. These could include:\n<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Refreshing their skills<\/li>\n\n\n\n<li>Taking part in decisions that affect their role<\/li>\n\n\n\n<li>Becoming familiar with new processes and procedures<\/li>\n\n\n\n<li>Preparing for any large changes happening in the company<\/li>\n\n\n\n<li>Catching up with coworkers and meeting new team members<\/li>\n<\/ul>\n\n\n\n<p>\nIt\u2019s important to note that social gatherings and visiting colleagues to introduce your little one are not covered under KIT days.\n<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"how-employers-should-process-payroll-for-kit-days\">How employers should process payroll for KIT days<\/h3>\n\n\n\n<p>\nWhatever hours the employee has worked as part of their \u201ckeeping in touch\u201d days must be paid at their <strong>normal working wage for the time worked<\/strong>. As an employer, it&#8217;s your responsibility to ensure that any hours worked under KIT days are paid accurately and on time.\n<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"if-an-employee-doesnt-return-to-work-following-their-leave\">If an employee doesn\u2019t return to work following their leave<\/h3>\n\n\n\n<p>Should an employee decide not to return to their place of work after taking parental leave, the employment period is considered to have ended at the start of taking parental leave. KIT days are frequently used by those who take parental leave so employers should ensure that they are prepared with a set approach.\n<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"implement-a-workplace-policy\">Implement a workplace policy<\/h3>\n\n\n\n<p>To ensure fairness and to support compliance, it\u2019s helpful to have a workplace policy around how KIT days are managed \u2013 or to include details in your parental leave policy. This way, you can outline the legal requirements for employees using KIT days, make it clear what the days should be used for and also make it easy for managers to understand the process when managing direct reports. With one approach for all, you also can ensure that no employee is getting preferential treatment. <\/p>\n\n\n\n<p>If workplace policies can be a bit of a drag, you might want to consider getting HR software to help. Or, to kill two birds with one stone, factor information around parental leave and KIT days into your next management training session. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"keep-up-communication\">Keep up communication<\/h3>\n\n\n\n<p>Remember that it\u2019s not the responsibility of the employee to stay up to date with all workplace changes, and you shouldn\u2019t rely solely on \u201ckeeping in touch\u201d days. <a href=\"https:\/\/employsure.co.nz\/guides\/maternity-and-parental-leave\/keeping-in-touch-days\" target=\"_blank\" rel=\"noopener\">Managers must inform<\/a> any reports on parental leave in the event of anything important affecting their role, or any promotion opportunities. <\/p>\n\n\n\n<p>It\u2019s beneficial for both the employer and employee if both parties maintain a certain level of communication throughout the leave period. By this, we don&#8217;t mean asking them to complete any work-related tasks or bothering them with work questions, but rather informing them of any big company changes and important workplace events they might want to attend. The employee may find this useful for when they return to the workplace in the future. <\/p>\n\n\n\n<p>Just remember that as an employee on leave, they&#8217;re not obligated to partake in anything related to work until the time comes for them to return to the office. <\/p>\n\n\n\n<p>Finally, it can be helpful for the employee or their manager to communicate upcoming KIT days across the team &#8211; whether that\u2019s by email or through setting up an event in a shared calendar.
