been part of their remuneration? In New Zealand, this practice can be quite common in industries like farming, tourism and hospitality, or when you\u2019re operating somewhere particularly remote.&nbsp;<\/p>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">Unfortunately, common misunderstandings about the legal requirements behind the arrangement can land employers in serious legal trouble. Some businesses confuse an employee for a volunteer, accidentally breaching fundamental employment rules. Others might not know that providing accommodation comes with its own conditions and responsibilities.&nbsp;<\/p>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">We\u2019re here to share the Government guidelines around <a href=\"https:\/\/www.employment.govt.nz\/assets\/uploads\/documents\/resolving-problems\/faqs-working-for-accommodation.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">working for board<\/a> as clearly as we can. As ever, this isn\u2019t legal advice, so we\u2019d highly recommend you seek independent legal counsel before formalising any arrangements.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Volunteer or employee?<\/h2>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">When it comes to working for accommodation, some employers will mistakenly pay their workers only in lodgings (accommodation) or board (accommodation and meals). And since they\u2019re not receiving a wage, the employer may deem the workers to be \u2018volunteers\u2019.&nbsp;<\/p>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">However, legally that\u2019s not correct. The <a href=\"https:\/\/www.employment.govt.nz\/assets\/uploads\/documents\/resolving-problems\/faqs-working-for-accommodation.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Ministry of Business, Innovation and Employment (MBIE) explicitly explained<\/a> a few years ago that as<strong> \u2018a person of any age employed by an employer to do any work for hire or reward under a contract of service<\/strong>\u2019, they fit the definition of an employee under the <a href=\"https:\/\/www.legislation.govt.nz\/act\/public\/2000\/0024\/latest\/DLM58317.html\" target=\"_blank\" rel=\"noreferrer noopener\">Employment Relations Act 2000<\/a>.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">If a worker meets any of the following conditions, they could potentially be classified as an employee:<\/p>\n\n\n\n<ul class=\"wp-block-list has-paragraph-2-m-font-size\">\n<li>The worker is being paid for their work \u2013 including rewards like board or lodgings<\/li>\n\n\n\n<li>The worker is performing tasks that are integral for the business<\/li>\n\n\n\n<li>Their hours of work are controlled<\/li>\n<\/ul>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">If legally classified as an employee, these workers should be provided the standard protections afforded by New Zealand employment law. That means receiving their minimum employment entitlements, including at least the minimum wage.&nbsp;<\/p>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\"><strong>It\u2019s not sufficient to use accommodation as payment. Instead, payment for work must be done with money.&nbsp;<\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Employee minimum rights<\/h3>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">As employees, workers have <a href=\"https:\/\/www.employment.govt.nz\/starting-employment\/rights-and-responsibilities\/employee-rights-and-responsibilities\" target=\"_blank\" rel=\"noreferrer noopener\">the following rights<\/a> to:<\/p>\n\n\n\n<ul class=\"wp-block-list has-paragraph-2-m-font-size\">\n<li>Have a written employment agreement<\/li>\n\n\n\n<li>Be paid at least the minimum wage for all hours worked<\/li>\n\n\n\n<li>Be paid in cash<\/li>\n\n\n\n<li>Not have money deducted from wages unless agreed to or legally obligated<\/li>\n\n\n\n<li>Have regular rest and meal breaks<\/li>\n\n\n\n<li>Receive relevant <a href=\"https:\/\/employmenthero.com\/nz\/resources\/holiday-pay\/\">leave entitlements<\/a>, in keeping with the Holidays Act 2003<\/li>\n\n\n\n<li>Resign at any time, working the notice period set out in their employee agreement<\/li>\n\n\n\n<li>Access the records that their employer has about their employment<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Guidelines when deducting board<\/h2>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">Employers and their employees are free to make an arrangement around accommodation and meals. The employer can either provide those for free, or if agreed to by the employee, can deduct costs from their wages. For your own compliance as an employer, it\u2019s critical that these arrangements are set out in writing.&nbsp;<\/p>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">The deductions have to be deemed a reasonable cost for board. If there\u2019s no specific agreement around the cost, employers are legally required to deduct no more than 15% of the employee\u2019s wages for food and accommodation, or 5% for accommodation only. This follows provisions in the <a href=\"https:\/\/www.legislation.govt.nz\/act\/public\/1983\/0115\/latest\/DLM74419.html?search=sw_096be8ed81ded905_board_25_se&amp;p=1&amp;sr=1\" target=\"_blank\" rel=\"noreferrer noopener\">Minimum Wage Act 1983<\/a>.&nbsp;<\/p>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">Finally, staying in the accommodation should be optional, and can\u2019t be a condition in order to work in the role.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Immigration and tax<\/h3>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">Sometimes employees who have accommodation with their role will be coming from overseas. As an employer, you have a responsibility to ensure that your workers have the legal right to work in New Zealand. That includes having a <a href=\"https:\/\/www.immigration.govt.nz\/work\/visas-for-working-in-new-zealand\/\">work visa<\/a>, rather than a visitor visa.<\/p>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">When it comes to tax, the value of the accommodation is taxable when used for lodgings. In keeping with the rules of employment, all the standard <a href=\"https:\/\/www.ird.govt.nz\/employing-staff\/deductions-from-income\/deductions-from-salary-and-wages\" target=\"_blank\" rel=\"noreferrer noopener\">Inland Revenue deductions<\/a> should be made from the employee\u2019s pay as well, including PAYE. It\u2019s worth noting that this may not include KiwiSaver, since only <a href=\"https:\/\/www.ird.govt.nz\/kiwisaver\/kiwisaver-individuals\/joining-kiwisaver\" target=\"_blank\" rel=\"noreferrer noopener\">New Zealand citizens or permanent residents<\/a> are eligible for the scheme.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Record-keeping<\/h3>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">Compliance starts with written documentation. Get everything in writing, including a formal employment agreement, the terms of any deductions for board or lodging, and the employee\u2019s agreement to the terms.&nbsp;<\/p>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">Remember as well that all employee records of wages, time, leave and relevant personal information need to be kept for a minimum of <a href=\"https:\/\/www.employment.govt.nz\/starting-employment\/rights-and-responsibilities\/record-keeping\" target=\"_blank\" rel=\"noreferrer noopener\">seven years<\/a>.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The accommodation<\/h2>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">Just as employers have health and safety responsibilities for their place of business, they also have responsibilities for any accommodation they provide. <a href=\"https:\/\/www.worksafe.govt.nz\/topic-and-industry\/worker-accommodation\/\" target=\"_blank\" rel=\"noreferrer noopener\">According to WorkSafe<\/a>, PCBUs (Person Conducting a Business or Undertaking) should ensure that their workers are not exposed to health and safety risks from the accommodation.&nbsp;<\/p>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">Essentially, employee accommodation should include adequate facilities and amenities and should be kept clean and hygienic. It should also be soundly built from weatherproof materials and if new, should comply with the <a href=\"https:\/\/www.legislation.govt.nz\/act\/public\/2004\/0072\/latest\/dlm306036.Html\" target=\"_blank\" rel=\"noreferrer noopener\">Building Act 2004<\/a>.&nbsp;<\/p>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">There are quite a few more detailed guidelines that can be found on the WorkSafe website around the size of rooms, provision of furnishings and washing\/laundry facilities. You can find the <a href=\"https:\/\/www.worksafe.govt.nz\/topic-and-industry\/worker-accommodation\/\" target=\"_blank\" rel=\"noreferrer noopener\">complete list here<\/a>.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The wrap-up<\/h2>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">The complexities of offering board or lodgings as part of employment shouldn&#8217;t put you off but the arrangement should be handled with care. As <a href=\"https:\/\/www.employment.govt.nz\/assets\/uploads\/documents\/resolving-problems\/faqs-working-for-accommodation.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">outlined by MBIE<\/a>, a person working for food and\/or accommodation in New Zealand is nearly always an employee, and they should be treated as such.<\/p>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">That means that they\u2019re paid in money for the work that they do and that board should only be included in addition for free, or for a mutually agreed wage deduction.&nbsp;<\/p>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">To protect your business from the risk of legal challenges and costly penalties, you\u2019ll have to pay your employee at least the minimum wage in money, adhere to the legal limits on deductions, fulfill your tax obligations and ensure safe accommodation.
