That means that it\u2019s a legal requirement for all New Zealand businesses to ensure that they\u2019re prioritising occupational health and safety.<\/p>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">Outside of the legal aspects (and from a business point of view), ensuring that your workplace is a comfortable and safe place to work reduces the chance of injury and sick leave. It is also important for employee happiness and retention in the long run.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Who is responsible for workplace health and safety duties?<\/h2>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">According to the Act, the responsibility of health and safety lies with two groups. Both these groups have duties to perform to keep a workplace safe.<\/p>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">The first group is classified as \u2018Persons Conducting a Business or Undertaking\u2019 (PCBU). This consists of employers, self-employed individuals, designers, principals and other leaders.<\/p>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">The other group are classified by the Act as Workers, and that includes employees and contractors.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What key health and safety responsibilities do employers have?<\/h2>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">As PBCUs, employers hold the primary duty of care for workplace health and safety. This doesn\u2019t just include their team members, but the people who come into contact with their business, such as customers, clients or the general public.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Some employer responsibilities include:<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-paragraph-2-m-font-size\">Providing necessary training and instruction to their team in order to mitigate workplace health and safety hazards<\/li>\n\n\n\n<li class=\"has-paragraph-2-m-font-size\">Monitoring the health of their workers to minimise the chance of illness and injury<\/li>\n\n\n\n<li class=\"has-paragraph-2-m-font-size\">Ensuring that the work environment is free from hazards<\/li>\n<\/ul>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">It\u2019s important to note that <a href=\"https:\/\/www.worksafe.govt.nz\/managing-health-and-safety\/getting-started\/understanding-the-law\/primary-duty-of-care\/what-is-the-primary-duty-of-care\/\" target=\"_blank\" rel=\"noreferrer noopener\">WorkSafe NZ specifies<\/a> that managing risks be done as far as is <strong>reasonably practicable<\/strong>.
