It can be used when the staff member is experiencing poor health, or when their partner or dependent requires care due to illness or injury.\n<h3>Can employers deny a sick leave request?<\/h3>\nThere is <a href=\"https:\/\/www.hcamag.com\/nz\/specialisation\/benefits\/can-employers-in-new-zealand-refuse-sick-leave\/320563\" target=\"_blank\" rel=\"noopener\">no law<\/a> to stop employers denying a sick leave request. However, if the employee has sick leave to use, they have a right for that request to be considered fairly and in good faith by the employer.\n<h3>Can employers ask for a medical certificate?<\/h3>\nYes, <a href=\"https:\/\/www.employment.govt.nz\/leave-and-holidays\/sick-leave\/requirement-for-medical-examination\/\" target=\"_blank\" rel=\"noopener\">employers can ask<\/a> for proof of illness in the event of a sick leave request. This should be specified in an employment agreement.\n<h3>Paid sick leave<\/h3>\nAll employees have <a href=\"https:\/\/www.employment.govt.nz\/leave-and-holidays\/sick-leave\/sick-leave-entitlements\/\" target=\"_blank\" rel=\"noopener\">10 days<\/a> of sick leave entitlement per year, provided they match the following criteria:\n<ul>\n \t<li aria-level=\"1\">They have worked for six months for the same employer, or<\/li>\n \t<li aria-level=\"1\">They have worked for the employer for six months for:\n<ul>\n \t<li aria-level=\"2\">An average of 10 hours per week, and<\/li>\n \t<li aria-level=\"2\">At least one hour in every week, or 40 hours in every month.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<a href=\"https:\/\/www.employment.govt.nz\/leave-and-holidays\/sick-leave\/sick-leave-entitlements\/\" target=\"_blank\" rel=\"noopener\">Sick leave is paid<\/a> at the rate of relevant daily pay. The only exception is if it\u2019s not possible to calculate the employee\u2019s daily pay, or if it varies in the pay period where the leave falls. In those instances, the employer can use average daily pay.\n<h3>Unused sick leave<\/h3>\nAt the end of the year period, up to 10 days of unused sick leave can be <a href=\"https:\/\/www.employment.govt.nz\/leave-and-holidays\/sick-leave\/sick-leave-entitlements\/\" target=\"_blank\" rel=\"noopener\">carried over<\/a> and added to the following year\u2019s entitlement.\n<h2>Tips for effective sick leave management<\/h2>\n<h3><\/h3>\n<h3>Have clear workplace policies in place<\/h3>\nIn a fair workplace, every employee requesting sick leave should have the same experience.
