There\u2019s plenty at stake too, with significant financial penalties of up to <a href=\"https:\/\/legislation.govt.nz\/act\/public\/2003\/0129\/latest\/DLM237183.html\" target=\"_blank\" rel=\"noreferrer noopener\">$20,000 for miscalculations<\/a>. We\u2019ve collected the key information you need in our factsheet, including pay definitions and a guide to the main calculations.&nbsp;<\/p>\n\n\n\n<p>We\u2019ve also added a summary below for annual leave and public holiday calculations. This is just a top level view, without the additional details available in the factsheet.&nbsp;&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Calculating pay for annual leave<\/h3>\n\n\n\n<p>When an employee takes annual leave, their annual holiday pay is at least the greater of:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Their ordinary weekly pay (OWP) as at the beginning of the annual holiday, or<\/li>\n\n\n\n<li>Their average weekly earnings (AWE) for the 12 months immediately before the end of the last pay period before the annual holiday is taken.<\/li>\n<\/ul>\n\n\n\n<p><em>Ordinary Weekly Pay (OWP) is the amount of pay an employee receives for an ordinary working week. If the OWP can\u2019t be determined, you can calculate the OWP by taking the gross earnings for the last 4 weeks and dividing that by 4.<\/em><\/p>\n\n\n\n<p><em>To calculate AWE, take the employee\u2019s gross earnings over the 12 months leading up to the last pay period before the annual holiday and divide that figure by 52. If the employee has been employed for less than 12 months, their AWE is the weekly average of their gross earnings for the time they have been employed.<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Calculating pay for public holidays<\/h3>\n\n\n\n<p>The employee is paid the Relevant Daily Pay (RDP) for each day they are off, or ADP if their RDP can\u2019t be calculated.<\/p>\n\n\n\n<p><em>Relevant Daily Pay (RDP) is the amount of pay an employee would have received if they had worked on a particular day. For a salaried employee, this is typically their standard daily rate. It\u2019s among a number of different leave payments that employers must make when an eligible employee takes paid leave.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Is holiday pay taxable in New Zealand?<\/h2>\n\n\n\n<p>Holiday pay is <a href=\"https:\/\/www.ird.govt.nz\/employing-staff\/deductions-from-income\/taxing-holiday-pay\" target=\"_blank\" rel=\"noreferrer noopener\">taxable by Inland Revenue<\/a> and it should be included as earnings when paid to an employee. It\u2019s subject to standard wage deductions, including PAYE, ACC levies, student loan repayments and KiwiSaver.&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Annual leave entitlements<\/h2>\n\n\n\n<p>Employees are entitled to four weeks of <a href=\"https:\/\/employmenthero.com\/nz\/blog\/understanding-accrued-leave-in-new-zealand\/\" target=\"_blank\" rel=\"noreferrer noopener\">annual leave<\/a> after 12 months of continuous employment for a single employer. They can take this leave in advance if mutually agreed with their employer.&nbsp;<\/p>\n\n\n\n<p>In limited circumstances, some employees may be paid holiday pay at the rate of not less than 8% of their gross earnings with their regular pay, instead of being provided with four weeks of annual leave each year. This is if the employee works so intermittently or irregularly that it is impractical for the employer to provide them with four weeks\u2019 annual holidays.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Public holiday entitlements&nbsp;<\/h2>\n\n\n\n<p>Employees get a paid day off on <a href=\"https:\/\/www.employment.govt.nz\/leave-and-holidays\/public-holidays\/\" target=\"_blank\" rel=\"noreferrer noopener\">public holidays<\/a> if it\u2019s otherwise a working day for them and are entitled to a maximum of 12 public holidays a year. If they have to work a public holiday due to stipulations in their employment agreement and it is an otherwise working day for them, they are entitled to an alternative day off. They should also be paid at least time and a half for the hours they work.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Sick leave and other leave types<\/h2>\n\n\n\n<p>There are a number of different leave types for employees in New Zealand. We\u2019ve included a few of the most common below.&nbsp;<\/p>\n\n\n\n<p>For these three leave types, employees are eligible if:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>They\u2019ve been employed continuously for 6 months with the same employer, or<\/li>\n\n\n\n<li>Have worked for their employer for 6 months for:\n<ul class=\"wp-block-list\">\n<li>an average of 10 hours per week, and<\/li>\n\n\n\n<li>at least 1 hour in every week or 40 hours in every month.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p>If the employee is not yet eligible, they may mutually agree with their employer to take the leave in advance.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Sick leave<\/h3>\n\n\n\n<p>Eligible employees in New Zealand receive 10 days\u2019 paid <a href=\"https:\/\/employmenthero.com\/nz\/resources\/managing-sick-leave-new-zealand\/\" target=\"_blank\" rel=\"noreferrer noopener\">sick leave<\/a> per year. They can also carry unused sick leave through to the next year and can accumulate a maximum of 20 sick days.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Bereavement leave (or compassionate leave)&nbsp;<\/h3>\n\n\n\n<p>Eligible employees can take a minimum of three days of paid <a href=\"https:\/\/employmenthero.com\/nz\/blog\/bereavement-leave\/\" target=\"_blank\" rel=\"noreferrer noopener\">bereavement leave<\/a> if a member of their immediate family or household dies, or one day of paid leave if someone close to them, outside of their immediate family, passes away.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Family violence leave<\/h3>\n\n\n\n<p>Eligible employees affected by family violence <a href=\"https:\/\/www.employment.govt.nz\/leave-and-holidays\/family-violence-leave\/\" target=\"_blank\" rel=\"noreferrer noopener\">are entitled to<\/a> take 10 days of paid <a href=\"https:\/\/employmenthero.com\/nz\/resources\/family-violence-leave-in-new-zealand\/\" target=\"_blank\" rel=\"noreferrer noopener\">family violence leave<\/a> per year.
