One significant error is missing mandatory clauses in the agreement, which is why we\u2019ve made this checklist. Without the correct information, the entire agreement is vulnerable.&nbsp;<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color has-paragraph-2-m-font-size wp-elements-d1969109c656fea5c54673bd1bc2c787\">Another is misusing different <a href=\"https:\/\/www.employment.govt.nz\/starting-employment\/types-of-worker\" target=\"_blank\" rel=\"noreferrer noopener\">types of employment<\/a>. It\u2019s critical that employers are aware of the difference between the types and how to use them correctly. For example, fixed-term contracts are only valid if there are genuine, objective reasons for the fixed term (like covering parental leave or a specific project). We\u2019ve seen employers incorrectly use them as a probationary period to test an employee.&nbsp;<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color has-paragraph-2-m-font-size wp-elements-3b5a85fede7fe976ca063badd2ed42a7\">There\u2019s also often confusion about the difference between permanent and casual employees. If an employee isn\u2019t working to the conditions of their type of employment, the employer could be at serious risk of legal penalties.&nbsp;<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color has-paragraph-2-m-font-size wp-elements-e3897cfd57fdf2dbfb73ef9eec1b01f8\">Similarly, be cautious when using additional clauses. For example, a <a href=\"https:\/\/www.employment.govt.nz\/starting-employment\/employment-agreements\/restraint-of-trade\" target=\"_blank\" rel=\"noreferrer noopener\">restraint of trade clause<\/a> must be deemed \u2018reasonable\u2019 by Employment New Zealand to be compliant.
