Understanding these categories helps you respond appropriately to employee requests and ensures you meet your legal obligations.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Primary carer leave<\/h3>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">Primary carer leave is for the person who will be the main caregiver for the new child. It\u2019s not dependent on gender like previous definitions of parental leave.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Partner&#8217;s leave<\/h3>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">Partner&#8217;s leave provides specific entitlements for partners at the time of birth or adoption. This leave acknowledges the important support role partners play during the early days of a new arrival.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Extended leave<\/h3>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">Extended leave allows the primary carer to take additional weeks of unpaid leave, past their primary carer leave allocation. This extended period recognises that some families need longer to establish care arrangements.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Special leave<\/h3>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">Special leave applies only to pregnant employees and is unpaid. It covers pregnancy-related medical appointments and provides essential time off during pregnancy.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Negotiated carer leave<\/h3>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">Negotiated carer leave is leave that employees can apply for if they don\u2019t qualify for primary carer leave. They must be the future primary carer of a child and already qualify for parental leave payments (which act separately from parental leave).&nbsp;<\/p>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">Unlike the other types of leave, employers can decline a request for negotiated carer leave. However, they must only decline on very specific <a href=\"https:\/\/www.legislation.govt.nz\/act\/public\/2016\/0008\/34.0\/DLM6553806.html#:~:text=An%20employer%20may%20refuse%20a%20request%20for%20negotiated%20carer%20leave,The%20grounds%20are%E2%80%94\" target=\"_blank\" rel=\"noreferrer noopener\">limited grounds related to business needs<\/a>.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" src=\"https:\/\/employmenthero.com\/nz\/wp-content\/uploads\/sites\/5\/2025\/10\/Expecting-parents-celebrating-pregnancy.png\" alt=\"\" class=\"wp-image-52802\"\/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Parental leave eligibility<\/h2>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">Parental leave eligibility depends on meeting <a href=\"https:\/\/www.employment.govt.nz\/leave-and-holidays\/parental-leave\/taking-parental-leave\/guide-for-employees\" target=\"_blank\" rel=\"noreferrer noopener\">specific employment criteria<\/a>. To be eligible for parental leave, employees must:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-paragraph-2-m-font-size\">Work for a NZ employer,<\/li>\n\n\n\n<li class=\"has-paragraph-2-m-font-size\">Have worked for them as an employee for an average of 10 hours a week for any 26 weeks of the 52 weeks before the child arrives,<\/li>\n\n\n\n<li class=\"has-paragraph-2-m-font-size\">Pay income tax to Inland Revenue, and&nbsp;<\/li>\n\n\n\n<li class=\"has-paragraph-2-m-font-size\">Be in an employment relationship which is subject to employment law.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">How much parental leave an employee is entitled to depends on the type of leave they&#8217;re taking.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Primary carer entitlements<\/h3>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">A primary carer can take up to <a href=\"https:\/\/www.employment.govt.nz\/leave-and-holidays\/parental-leave\/types-of-parental-leave\/primary-carer-leave\" target=\"_blank\" rel=\"noreferrer noopener\">26 weeks of parental leave<\/a>. If they\u2019ve worked for their employer for at least 12 months, they can also take an additional 26 weeks of extended leave.\u00a0<\/p>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">During parental leave, the primary carer may be eligible for government-funded parental leave payments for up to 26 weeks, subject to criteria administered by <a href=\"https:\/\/www.ird.govt.nz\/paid-parental-leave\" target=\"_blank\" rel=\"noreferrer noopener\">Inland Revenue<\/a>. The payment rate is based on the person&#8217;s average weekly earnings, although it has a maximum weekly payment of $788.66 a week.<\/p>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">Job protection provisions ensure the primary carer can return to the same position at the end of their parental leave. The only exception is if the role becomes redundant or if it\u2019s a \u2018key position\u2019 in your business, according to <a href=\"https:\/\/www.employment.govt.nz\/leave-and-holidays\/parental-leave\/taking-parental-leave\/what-happens-while-on-parental-leave-and-your-return\" target=\"_blank\" rel=\"noreferrer noopener\">Employment New Zealand criteria<\/a>.\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Partner entitlements<\/h3>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">Partners have more <a href=\"https:\/\/www.employment.govt.nz\/leave-and-holidays\/parental-leave\/types-of-parental-leave\/partners-leave\" target=\"_blank\" rel=\"noreferrer noopener\">limited entitlements<\/a> designed to provide support during the immediate period following birth or adoption. They can take up to 2 weeks of unpaid leave, which must be taken within 21 days of the birth or the child coming into their care through adoption. This leave can be taken as a continuous period or split into separate periods within the 21-day timeframe.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is Paid Parental Leave (PPL)?<\/h2>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">Paid Parental Leave (PPL) provides income support from the Government during parental leave periods. It\u2019s administered by Inland Revenue, rather than employers. Understanding how this system works will help you support employees through the application process and manage your payroll obligations correctly.<\/p>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">Employees may be eligible for PPL if they meet <a href=\"https:\/\/www.ird.govt.nz\/paid-parental-leave\/qualifying\/work-requirements\" target=\"_blank\" rel=\"noreferrer noopener\">specific criteria<\/a>, including the duration of their current employment and whether they pay income tax in New Zealand. The payment is calculated based on average weekly earnings over a qualifying period, subject to maximum payment rates set by the government.<\/p>\n\n\n\n<p class=\"has-paragraph-2-m-font-size\">While Inland Revenue handles paid parental leave, employers may still have a part to play.
