Additional requirements apply.<\/li>\n<\/ol>\n<h2 id=\"who-is-covered-by-the-singapore-employment-act\">Who is covered by the Singapore Employment Act?<\/h2>\nBoth local and foreign employees are covered by the Employment Act, as long as you are an employee working under a contract of service with an employer. Employees can be employed on a full-time, part-time, temporary and contract basis, and be paid hourly, daily, monthly, or by piece-rate.\n\nIndividuals employed as the following are not covered under the Employment Act:\n<ul>\n<li>Seafarers;<\/li>\n<li>Domestic workers; and<\/li>\n<li>Statutory board employees or civil servants.<\/li>\n<\/ul>\nFor those not covered by the Employment Act, the terms and conditions of their employment will be according to their employment contract instead.\n\nManagers and executives with a basic monthly salary of more than $4,500 were previously not covered by the Employment Act. However, after <a href=\"https:\/\/www.mom.gov.sg\/employment-practices\/employment-act\/amendments-to-the-act\" rel=\"noopener\" target=\"_blank\">amendments were made to the act<\/a> in 2019, all employees in Singapore with the exception of the aforementioned, are covered for core provisions such as:\n<ul>\n<li>Minimum days of annual leave;<\/li>\n<li>Paid public holidays and sick leave;<\/li>\n<li>Timely payment of salary; and<\/li>\n<li>Statutory protection against wrongful dismissal.<\/li>\n<\/ul>\n<h2 id=\"employer-obligations-when-hiring-employees\">Employer obligations when hiring employees<\/h2>\n<img loading=\"lazy\" decoding=\"async\" alt=\"two colleagues chatting in the office\" class=\"alignnone size-full wp-image-4421\" height=\"806\" src=\"https:\/\/employmenthero.com\/sg\/wp-content\/uploads\/sites\/2\/2022\/07\/image3.png\" width=\"1074\" srcset=\"https:\/\/employmenthero.com\/sg\/wp-content\/uploads\/sites\/3\/2022\/07\/image3.png 1074w, https:\/\/employmenthero.com\/sg\/wp-content\/uploads\/sites\/3\/2022\/07\/image3-300x225.png 300w, https:\/\/employmenthero.com\/sg\/wp-content\/uploads\/sites\/3\/2022\/07\/image3-1024x768.png 1024w, https:\/\/employmenthero.com\/sg\/wp-content\/uploads\/sites\/3\/2022\/07\/image3-768x576.png 768w\" sizes=\"auto, (max-width: 1074px) 100vw, 1074px\" \/>\n<h3 id=\"1-central-provident-fund-cpf-contributions\">1. Central Provident Fund (CPF) contributions<\/h3>\nTo hire a Singaporean or a Singapore permanent resident (PR) employee, you need to apply for a <a href=\"https:\/\/www.cpf.gov.sg\/employer\/making-cpf-contributions\/applying-for-a-cpf-submission-number\" rel=\"noopener\" target=\"_blank\">CPF Submission Number (CSN)<\/a> to make CPF contributions as an employer.\n\nIt is a unique identifier that you will use to transact with the CPF Board, such as making CPF payments or making requests relating to employer matters. Each CSN consists of an Unique Entity Number (UEN) or NRIC\/FIN (if you\u2019re trading under your own name) and your CPF Payment Code.\n\nYou\u2019re required to make two contributions to your employees\u2019 CPF accounts every month:\n<ul>\n<li>Employee\u2019s contribution: deducted from their salary; and<\/li>\n<li>Employer\u2019s contribution: a fixed percentage of the employee\u2019s wage, provided on top of their existing salary.<\/li>\n<\/ul>\nIf your employee is earning more than $750 per month, you\u2019re permitted to deduct the employee\u2019s share of mandatory CPF contributions from their wages. The CPF contribution rates are not fixed for everyone, but rather are dependent on an employee\u2019s age, and their <a href=\"https:\/\/www.cpf.gov.sg\/content\/dam\/web\/employer\/employer-obligations\/documents\/CPFContributionRatesTable_1Jan2022.pdf\" rel=\"noopener\" target=\"_blank\">permanent resident status<\/a>.\n\nThese are the existing CPF rates:\n\n<figure id=\"attachment_4422\" aria-describedby=\"caption-attachment-4422\" style=\"width: 727px\" class=\"wp-caption alignnone\"><a href=\"https:\/\/www.cpf.gov.sg\/employer\/employer-obligations\/how-much-cpf-contributions-to-pay\"><img loading=\"lazy\" decoding=\"async\" alt=\"Existing CPF contribution rates\" class=\"size-full wp-image-4422\" height=\"412\" src=\"https:\/\/employmenthero.com\/sg\/wp-content\/uploads\/sites\/2\/2022\/07\/image4.png\" width=\"727\" srcset=\"https:\/\/employmenthero.com\/sg\/wp-content\/uploads\/sites\/3\/2022\/07\/image4.png 727w, https:\/\/employmenthero.com\/sg\/wp-content\/uploads\/sites\/3\/2022\/07\/image4-300x170.png 300w\" sizes=\"auto, (max-width: 727px) 100vw, 727px\" \/><\/a><figcaption id=\"caption-attachment-4422\" class=\"wp-caption-text\">Image via CPF Board<\/figcaption><\/figure>\n\nTake note however, that the CPF contribution rates for employees aged above 55 to 70 will be increased from 1 January 2023, to strengthen retirement adequacy. Employers who fail to pay by the 14th of the following month (or the next working day if the 14th falls on a Saturday, Sunday, or public holiday) will face enforcement action, which includes late payment interest charged at 1.5% per month, commencing from the first day after the due date.\n<h3 id=\"2-ensure-fair-and-anti-discriminatory-hiring-practices\">2. Ensure fair and anti-discriminatory hiring practices<\/h3>\nTo ensure fair hiring and employment practices, employers in Singapore must adhere to the requirements outlined in the <a href=\"https:\/\/www.mom.gov.sg\/employment-practices\/fair-consideration-framework\" rel=\"noopener\" target=\"_blank\">Fair Consideration Framework (FCF)<\/a> and the <a href=\"https:\/\/www.tal.sg\/tafep\/resources\/publications\/2019\/tripartite-guidelines-on-fair-employment-practices\" rel=\"noopener\" target=\"_blank\">Tripartite Guidelines on Fair Employment Practices.<\/a>\n\nSingapore is a meritocratic society, and prides itself on ensuring that fair and merit-based employment practices are implemented. Employers must seek to recruit and select employees based on their skills, experience, or ability to perform the job, regardless of age, race, gender, religion, marital status, family responsibilities, or disability.\n\nWith such a diverse workforce in multiracial and multicultural Singapore, it\u2019s important for employers to treat jobseekers fairly and with respect. This not only widens the pool of potential candidates, it also increases the chances of finding the right person for the role you\u2019re hiring for. The selection criteria and recruitment process for each role should be consistent and made known to all applicants.\n\nEmployers are also actively encouraged to hire and develop Singaporeans as the core of their workforce, while foreigners play a valuable role in complementing the existing workforce.\n\nThe Ministry of Manpower (MOM) takes cases of discriminatory hiring practices seriously \u2014 it proactively identifies employers with indications of such practices and places them on a watchlist for closer scrutiny.\n<h3 id=\"3-create-employment-contracts-compliant-with-the-employment-act\">3. Create employment contracts compliant with the Employment Act<\/h3>\nAs an employer, you must have a written <a href=\"https:\/\/www.mom.gov.sg\/employment-practices\/contract-of-service\/what-is-a-contract-of-service\" rel=\"noopener\" target=\"_blank\">contract of service<\/a> that defines the employer-employee relationship, including the terms and conditions of employment.\n\nThe contract must include <a href=\"https:\/\/www.mom.gov.sg\/employment-practices\/contract-of-service\/key-employment-terms\" rel=\"noopener\" target=\"_blank\">key employment terms (KETs)<\/a> and essential clauses, such as:\n<ol>\n<li>Full name of employer and employee;<\/li>\n<li>Job title, main duties and responsibilities;<\/li>\n<li>Commencement date of employment;<\/li>\n<li>Duration of employment (if employee is on fixed term contract);<\/li>\n<li>Working arrangements such as daily hours of work, number of working days per week, rest days;<\/li>\n<li>Remuneration (salary period, basic salary or basic rate of pay for those paid by hour, day, or by piece);<\/li>\n<li>Fixed allowances\/deductions;<\/li>\n<li>Overtime payment period and overtime rate of pay;<\/li>\n<li>Bonuses and incentives;<\/li>\n<li>Type of leave (annual leave, sick leave, hospitalisation leave, maternity leave, childcare leave);<\/li>\n<li>Insurance, medical benefits and dental benefits;<\/li>\n<li>Probation period (if any);<\/li>\n<li>Termination of contract, notice period; and<\/li>\n<li>Place of work (optional).<\/li>\n<\/ol>\n<h3 id=\"4-purchase-work-injury-compensation-insurance\">4. Purchase work injury compensation insurance<\/h3>\nEmployers are required to buy <a href=\"https:\/\/www.mom.gov.sg\/workplace-safety-and-health\/work-injury-compensation\/work-injury-compensation-insurance\" rel=\"noopener\" target=\"_blank\">work injury compensation insurance<\/a> for both local and foreign employees, if they are:\n<ul>\n<li>Doing manual work, regardless of salary level; or<\/li>\n<li>Doing non-manual work and earning a salary of $2,600 or less a month, excluding any overtime payment, bonus payment, annual wage supplement, productivity incentive payment and any allowance.<\/li>\n<\/ul>\nIf your employee doesn\u2019t fall under any of the above categories, you have the flexibility to decide whether you want to purchase insurance for them. If your employees make a valid claim however, you will have to compensate them regardless of whether they are insured.\n\nIt\u2019s also important to note that you must buy or renew your insurance policy from the list of <a href=\"https:\/\/www.mom.gov.sg\/-\/media\/mom\/documents\/safety-health\/lists\/designated-insurers.pdf\" rel=\"noopener\" target=\"_blank\">designated insurers<\/a>, and your policies must comply with MOM\u2019s compulsory terms.\n\nThis helps to ensure that the policy coverage is adequate for any <a href=\"https:\/\/www.mom.gov.sg\/workplace-safety-and-health\/work-injury-compensation\/what-is-wica\" rel=\"noopener\" target=\"_blank\">Work Injury Compensation Act (WICA)<\/a> claims.\n<h3 id=\"5-skills-development-levy-sdl-contributions\">5. Skills Development Levy (SDL) contributions<\/h3>\nIn addition to <a href=\"https:\/\/employmenthero.com\/sg\/solutions\/cpf-calculations\/\">CPF contributions<\/a>, you will also have to pay a compulsory levy \u2014 the <a href=\"https:\/\/www.cpf.gov.sg\/employer\/employer-obligations\/skills-development-levy\" rel=\"noopener\" target=\"_blank\">Skills Development Levy (SDL)<\/a> for all your employees, regardless of whether they are Singapore citizens or foreign nationals. The CPF Board collects the SDL on behalf of the SkillsFuture Singapore Agency.\n\nIf you\u2019re wondering what it\u2019s used for, the SDL amount collected is actually channelled to the Skills Development Fund, which is used to support workforce upgrading programmes and <a href=\"https:\/\/employmenthero.com\/sg\/resources\/business-grants-portal\/\">provide training grants<\/a> to you, when you send your employees for training under the National Continuing Education Training system.\n\nThe levy payable for each employee is 0.25% of their total monthly wage \u2014 the minimum payable is $2 for employees earning less than $800 a month, and the maximum payable is $11.25 for employees earning more than $4,500 a month. You can use the SDL calculator for easy calculations, or the auto-computation feature under CPF EZPay when you pay for SDL together with your CPF contributions.\n<h3 id=\"6-issue-itemised-payslips\">6. Issue itemised payslips<\/h3>\nIt is compulsory for employers to issue itemised payslips to employees in Singapore if they are covered under the Employment Act. You must issue the payslips together with the payment of salary to your employee. If you are unable to issue both together, then you have to provide the payslip within 3 working days of the salary payment.\n\nYou are also legally required to provide the following details in the payslip:\n<ul>\n<li>Employer\u2019s full name;<\/li>\n<li>Employee\u2019s full name;<\/li>\n<li>Start and end date of salary period;<\/li>\n<li>Date of payment;<\/li>\n<li>Mode of payment;<\/li>\n<li>Basic salary (for hourly, daily or piece-rate workers, indicate the basic rate of pay and the total number of hours or days worked or pieces produced);<\/li>\n<li>Total allowances with a breakdown shown;<\/li>\n<li>Any other additional payments with a breakdown shown;<\/li>\n<li>Fixed deductions (e.g. employee\u2019s CPF contribution);<\/li>\n<li>Ad-hoc deductions (e.g. deductions for no-pay leave, absence from work);<\/li>\n<li>Overtime hours worked;<\/li>\n<li>Overtime pay;<\/li>\n<li>Start and end date of overtime payment period;<\/li>\n<li>Net salary paid in total; and<\/li>\n<li>Employer\u2019s CPF contributions.<\/li>\n<\/ul>\nYou\u2019re also required to keep records of your current employee\u2019s payslips for the last 2 years, and if they are former employees, you\u2019ll have to keep the last 2 years of records for at least 1 year after their last day of employment.\n<h2 id=\"additional-requirements-for-hiring-foreign-employees\">Additional requirements for hiring foreign employees<\/h2>\n<img loading=\"lazy\" decoding=\"async\" alt=\"Group of local and foreign employees chatting together\" class=\"alignnone size-full wp-image-4424\" height=\"806\" src=\"https:\/\/employmenthero.com\/sg\/wp-content\/uploads\/sites\/2\/2022\/07\/image1.png\" width=\"1074\" srcset=\"https:\/\/employmenthero.com\/sg\/wp-content\/uploads\/sites\/3\/2022\/07\/image1.png 1074w, https:\/\/employmenthero.com\/sg\/wp-content\/uploads\/sites\/3\/2022\/07\/image1-300x225.png 300w, https:\/\/employmenthero.com\/sg\/wp-content\/uploads\/sites\/3\/2022\/07\/image1-1024x768.png 1024w, https:\/\/employmenthero.com\/sg\/wp-content\/uploads\/sites\/3\/2022\/07\/image1-768x576.png 768w\" sizes=\"auto, (max-width: 1074px) 100vw, 1074px\" \/>\n<h3 id=\"1-be-compliant-with-the-employment-of-foreign-manpower-act-efma\">1. Be compliant with the Employment of Foreign Manpower Act (EFMA)<\/h3>\nApart from areas such as salary, hours of work, overtime and rest days, public holidays, annual leave and sick leave for foreign employees which are covered by the Employment Act, the <a href=\"https:\/\/www.mom.gov.sg\/legislation\/employment-of-foreign-manpower-act\" rel=\"noopener\" target=\"_blank\">Employment of Foreign Manpower Act<\/a> (EFMA) covers regulations of work passes and enforcement for any offences or infringements.\n\nWork passes include the Employment Pass, S Pass and Work Permit \u2014 and the EFMA covers employers of foreign employees and any person issued a work pass by the Ministry of Manpower. It outlines the responsibilities employers need to fulfil relating to applications, medical insurance, levy, cancellation and repatriation.\n<h3 id=\"2-set-up-a-work-pass-account-to-obtain-a-valid-work-visa-for-employees\">2. Set up a work pass account to obtain a valid work visa for employees<\/h3>\nTo hire a foreign employee in Singapore, you need to first <a href=\"https:\/\/www.mom.gov.sg\/eservices\/services\/work-pass-account-registration-wpar\" rel=\"noopener\" target=\"_blank\">set up a work pass account<\/a>, which allows you to do the following:\n<ul>\n<li>Register for an Employment Pass Online account;<\/li>\n<li>Register for a Work Permit Online account;<\/li>\n<li>Declare your business activity (formerly known as industrial classification); and<\/li>\n<li>Check the status of your registration.<\/li>\n<\/ul>\nUnder the Employment Act, all foreigners require a valid work visa to work in Singapore, and employers are required to apply for it on their behalf. This has to be completed before the employee can start work with the employer.\n\nThere are many <a href=\"https:\/\/www.mom.gov.sg\/passes-and-permits\" rel=\"noopener\" target=\"_blank\">different work passes available<\/a> for foreigners, which are largely dependent on their skills, wages, and family ties. The three main types of work passes are the work permit, S Pass, or Employment Pass (EP), and you will have to assess which one your employee requires and fulfils the criteria needed, before applying for it online via your work pass account.\n\nYou should also take note of the <a href=\"https:\/\/www.mof.gov.sg\/docs\/librariesprovider3\/budget2022\/download\/pdf\/annexc4.pdf\" rel=\"noopener\" target=\"_blank\">changes made to the minimum qualifying salaries<\/a> of EP and S Pass holders from Budget 2022.\n<h3 id=\"3-be-compliant-with-the-fair-consideration-framework-fcf-for-job-advertisements\">3. Be compliant with the Fair Consideration Framework (FCF) for job advertisements<\/h3>\nBefore you can even apply for a valid EP or S Pass, you\u2019re required to advertise the job opening on <a href=\"https:\/\/www.mycareersfuture.gov.sg\/\" rel=\"noopener\" target=\"_blank\">MyCareersFuture<\/a> and consider all candidates fairly. The job posting must also be open for at least <strong>28 consecutive days<\/strong>, to provide sufficient time for jobseekers to view and apply for the vacancy.\n\nIf you make any changes to the job posting (e.g. job title, salary or number of vacancies), you\u2019re required to keep it open for <strong>at least another 28 consecutive days<\/strong> before you can submit the EP or S Pass application. This is to ensure that job seekers are aware of the changes, and continue having a chance to apply for the role.\n\nTake note that if your job advertisements have expired or closed for <strong>more than 3 months<\/strong>, they cannot be used for EP or S Pass applications. You must advertise the job vacancy again, to reach out to other jobseekers.\n\nThere are exemptions however \u2014 if you meet any of the following requirements, you will not need to advertise your job availability on MyCareersFuture.\n<ul>\n<li>Your company has fewer than 10 employees;<\/li>\n<li>The fixed monthly salary for the vacancy is $20,000 and above;<\/li>\n<li>The role is short-term, i.e. not more than 1 month;<\/li>\n<li>The role is to be filled by a local transferee, i.e. an existing employee from your company in Singapore transferring to another related branch, subsidiary, or affiliate in Singapore; or<\/li>\n<li>The role is to be filled by a candidate choosing to apply as an overseas intra-corporate transferee under the World Trade Organisation\u2019s General Agreement on Trade in Services or an applicable Free Trade Agreement that Singapore is party to.<\/li>\n<\/ul>\n<h3 id=\"4-foreign-worker-levy-fwl-dependency-ratio-ceiling-drc\">4. Foreign Worker Levy (FWL) &amp; dependency ratio ceiling (DRC)<\/h3>\nAll companies in Singapore are required to pay <a href=\"https:\/\/www.mom.gov.sg\/passes-and-permits\/work-permit-for-foreign-worker\/foreign-worker-levy\/what-is-the-foreign-worker-levy\" rel=\"noopener\" target=\"_blank\">foreign worker levy<\/a> for their work permit and S Pass holders \u2014 this levy was introduced by the government to help regulate the number of foreign workers in the country.\n\nThe amount of FWL to be paid for each worker generally depends on the worker\u2019s qualifications, the number of S Pass and work permit holders hired in the company, and the sector the employer belongs to.\n\nUpgrading your workers to a higher skilled status also benefits your company, as you pay a lower levy. This is known as the <a href=\"https:\/\/www.mom.gov.sg\/passes-and-permits\/work-permit-for-foreign-worker\/foreign-worker-levy\/skilled-worker-levy\" rel=\"noopener\" target=\"_blank\">higher-skilled worker levy<\/a>, and the rates are different for each sector.\n\nThere\u2019s also a <a href=\"https:\/\/www.mom.gov.sg\/passes-and-permits\/work-permit-for-foreign-worker\/foreign-worker-levy\/calculate-foreign-worker-quota\" rel=\"noopener\" target=\"_blank\">dependency ratio ceiling<\/a> or quota implemented in each company, which is the maximum ratio of foreign employees to the total workforce that a company in a given sector can employ. For example, if the quota for the manufacturing sector is 60%, then only 60% of a manufacturing company\u2019s total workforce can comprise of S Pass and Work Permit holders. It won\u2019t be applicable to you if you\u2019re hiring your first employee, but for bigger companies, it is crucial to stick to the quota provided.\n<h2 id=\"other-annual-requirements-for-hiring-employees\">Other annual requirements for hiring employees<\/h2>\n<h3 id=\"\"><\/h3>\n<h3 id=\"reporting-employee-earnings-ir8a-ir8s\">Reporting employee earnings (IR8A, IR8S)<\/h3>\nAs an employer, you are required to complete <a href=\"https:\/\/www.iras.gov.sg\/taxes\/individual-income-tax\/employers\/auto-inclusion-scheme-(ais)-for-employment-income\/reporting-employee-earnings-(ir8a-appendix-8a-appendix-8b-ir8s)\" rel=\"noopener\" target=\"_blank\">Form IR8A, Appendix 8A, Appendix 8B, and Form IR8S (where applicable)<\/a> for all your employees who are employed in Singapore by 1st March every year.\n\nEmployers with less than 5 employees are also welcome to join the <a href=\"https:\/\/employmenthero.com\/sg\/resources\/iras-auto-inclusion-scheme\/\">Auto Inclusion Scheme (AIS)<\/a> under the Inland Revenue Authority of Singapore (IRAS) if they want to, but it is deemed compulsory for employers with more than 5 employees to participate in it.\n\nIt helps to simplify tax filing for your employees, because the income information submitted by employers will be automatically included in your employee\u2019s tax returns.
