The <\/span><a href=\"https:\/\/www.gov.uk\/government\/news\/parents-to-receive-day-one-right-to-neonatal-care-leave-and-pay\"><span style=\"font-weight: 400;\">press release<\/span><\/a><span style=\"font-weight: 400;\"> published this week outlines the new laws that are set to come into effect from 6 April 2025.&nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400;\">This legislation update might ring a bell, as the basis of it \u2013 the <\/span><a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/2023\/20\"><i><span style=\"font-weight: 400;\">Neonatal Care (Leave and Pay) Act<\/span><\/i><\/a><span style=\"font-weight: 400;\"> \u2013 was passed in 2023.&nbsp; However, the Government is only now making plans to implement the provisions in the Act.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400;\">To get a better idea of what the updated neonatal legislation means, and how it might impact your business, keep reading.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"what-is-neonatal-leave\"><span style=\"font-weight: 400;\"><strong>What is neonatal leave?<\/strong><\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400;\">The new neonatal care leave is intended to support parents of babies who are admitted into neonatal care within 28 days of birth, and who have a continuous stay in hospital of seven full days or longer. Currently, there is no specific leave for parents with babies that require prolonged stays in hospital, so the <a href=\"https:\/\/employmenthero.com\/uk\/blog\/a-detailed-look-at-the-employment-rights-bill\/\">new legislation<\/a> will make a big difference to employees in this challenging position.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400;\">&nbsp;It is most likely to benefit parents with children born prematurely or who have complications at birth and is designed to ensure employees do not feel pressure to return to work earlier than they want to.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"what-do-businesses-need-to-keep-in-mind-about-the-updated-rights\"><span style=\"font-weight: 400;\"><strong>What do businesses need to keep in mind about the updated rights?&nbsp;<\/strong><\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400;\">It\u2019s important to note that Neonatal Care Leave will be a \u201cday-one\u201d right, meaning it\u2019s available to an employee from their first day in a new job. The legislation also states that parents will be able to take up to 12 weeks of leave on top of any other leave they are entitled to, including maternity and paternity leave.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"will-the-leave-be-paid-or-unpaid\"><span style=\"font-weight: 400;\"><strong>Will the leave be paid or unpaid?<\/strong><\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400;\">One of the main questions we imagine both business owners and employees will want to know the answer to is, will this leave be paid or unpaid?&nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400;\">Alongside the new leave entitlement, Statutory Neonatal Care Pay will be available to those employees who have been continuously employed for 26 weeks and meet a minimum earnings threshold.&nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400;\">The exact details, including the rate of pay, are yet to be confirmed. So watch this space for further updates.&nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400;\">The obligation to make payment for the leave will fall on employers, although the government anticipates that claims will be infrequent. Small businesses will be able to reclaim the costs of payment for the leave from the government, whilst larger businesses will be able to reclaim a portion of the costs.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"get-prepared-with-employment-hero\"><span style=\"font-weight: 400;\"><strong>Get prepared with 91±¬ΑΟ&nbsp;<\/strong><\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400;\">Changes in legislation can be daunting for businesses, but being prepared can reduce that.
